My rights as the artist

I reserve the right to refuse a commission from a client for any reason
(rude/unwilling to work or pay/blocklisted)I reserve the right to amend these Terms at any time. The client('s) continued use of the Services following the posting of revised Terms signifies your acceptance of the Modifications.I reserve the right to use commissioned work for a portfolio or future advertising
on social media or elsewhereThe ownership, title, and interest of the created works, and the copyright therein shall remain vested in the Artist, No rights other than those licensed on request. (By default is a limited, non-transferable, and revocable license) as stated in the terms here shall be exercised by the client.I also reserve the right to keep or sell the commissioned work to Public or private domain or private individuals if it has not been paid for after completion or cancellation. (more info listed in the Payment Information section)Also, this really should not need to be said but,
UNDER NO CIRCUMSTANCES MAY MY WORK EVER BE USED FOR NFTs (Non-Fungible Tokens)
OR used as input to, as an accessory to, or in any media of any kind involving generative AI.
This is why we can't have nice things :)

Your rights as the client

After work is completed the client has the right to make any changes you want as long as you credit me for the original design and specify your edits when you post it to social media excluding removing my watermark/logo(s)I will try to make any watermark I add to my work as small/unnoticeable as possible to not interfere with the work itself. (if applicable)Once the model file(s) has been handed over to the client it will be the client('s) responsibility to keep them. I will only keep files for about 1-3 weeks on google drive depending on how big my queue is. After they will go into a zipped folder and onto my NAS for long-term archiving. if I still have the file(s) the client('s) have every right to request it!The client('s) are allowed to use commissioned work for any personal use (privately uploaded avatars, streaming/videos without monetization etc..)

The client('s) usage rights of your commission depend on whether you are granted a personal or commercial use license. A standard commission is for personal use only
The client('s) must request for commercial use by default.

Work schedule

I work on commissions from Monday to Friday
8AM-10PM ESTmy days off are Saturday and Sunday.
Please don't message me about commissions on my days off unless it is urgent (payment changes/cancellation etc),I need time to have a life outside of commissions to ensure I don't get burnt out of doing work.

Product Delivery

The client('s) will receive a download link/email or private message containing the following upon payment:

If you commissioned a texture:
A .ZIP/.RAR File containing your texture files in the standard PNG/JPEG format
Unity package containing premade materials for your textured model (if applicable)If you commissioned a model/model asset
Blender file and unity package with the model setup
Along with the previously mentioned textures included in the unity-packageIf you are commissioning me and you know how to upload the avatar yourself, Then I will provide you with the necessary files to upload the avatar yourself upon completion of the commission. Otherwise I can upload it for you and transfer the files at no extra charge during the time of the commission.

Misc. Information

My work, by default is PC compatible only.
Android/standalone/IOS compatibility is an offered service, prior notice from the client is needed in this case to tailor it to Standalone playersslots are generally first-come/first-serve. My trello board has three spots (waiting/in-progress/working-on) If I feel like I can get another clients commission done to keep my line moving as quickly as possible, I will take that on first.The services and deliverables provided under this agreement are offered "as is" without any warranties of any kind, either express or implied (how and why the fuck would you even warranty this shit-)ㅤ

The client('s) agrees to not use my work to create offensive or discriminatory content.

I will not make Discriminatory/stolen content for the client('s)in the rare case I do have to work slower on commission's (family emergency, health problems, ect.) I will inform the client('s) if their commission is going to take longer than expected if that is the case.Prices for certain things vary based on the complexity of the character or animation and/or the amount of work I must perform you will be notified if that is the case.There will be additional fees if you wish for me to use something such as a shader or base model/mesh that must be purchased it will be included in the total price of the client's commission if that is the case.This site is geared towards VRChat related commissions but I do take general rigging/rendering/texture commissions. The rates listed in either price category apply depending on the work. If you have any questions please feel free to contact me!I will ask for proof of model ownership if I am working from a paid base model if the client('s) are suspected of not owning it legallyWait Times will vary depending on complexity (Wait times can not be guaranteed but I will be transparent with the client('s) if a commission will take longer than discussed)Prices may vary on the complexity of the commission. If the client has a deadline to adhere to, please make sure to state beforehand; For strict or fast deadlines, an additional charge may be applied.

The client must give proper credit when my work is posted online or otherwise used.
(does not apply to commercial use clients).The reselling or free public distribution of your commission is strictly forbidden under all circumstances (does not apply to commercial use clients and/or VRChat clone-able models).

Blocklisting

Anyone is liable to be Blocklisted from my current or future services/sales if any of the following are breached:

If the client is a zoophile/pedophile or engage/endorse them
(instant blocklist no exceptions or refunds)The client's Contact details are falsified or intentionally redacted to hide required information.
(Example: age verification for NSFW work)Stealing ("Ripping" or otherwise illegally obtaining) commissioned work (or) Leaking my work to unapproved and/or piracy sites.

Claiming commissioned work as your own (does not apply to commercial use clients).Additionally, The client is subject to be blocklisted at any time if other creators show proof of serious breaches of either their Terms of service (TOS) or illegal activities that do not coincide with my TOS or applicable law.
This applies to all clients personal or commercialBlocklisted users acknowledge that they forfeit any right to refunds for services already provided. All payments made up to the date of blocklisting are final,

Payment Information

All payments are to be made in USD currency or converted into USDDue to the nature of this being a digital resource, A minimum deposit of 30% of the total commission cost will be required up-front before I start working on your commission. once work starts the 30% amount determined by the total cost is NON-REFUNDABLE You do not need to pay anything until I can reasonably start on your work.

I do invoicing if paying through PayPalIf the client chooses to cancel the commission after I start work, I will retain an amount paid determined by the amount of work completed at the time of cancellation (including the minimum deposit amount) and a 2% fee to cover PayPal's transfer cost (only if applicable)

The client is responsible for the use of the product. I do not hold responsibility for any legal claims, harm damages made due to use of the product on behalf of the client.

if you file a charge-back after you have received the files/work any applicable rights of the client are automatically forfeited, you will be blacklisted and I am able to sell or distribute the work to public or private domain. Along with take legal action if required.When a payment (being either of the prior options) has been made I will send proof of the transaction (me stating I received payment and/or a screenshot of the transaction) for you to keep as proof of work from meIf the full price is not paid within a reasonable time-frame, (a month after completion unless we specifically come to an agreement on another time-frame) I will send multiple reminder's in an attempt to reach you before any opportunity to pay closes. If that window closes any amount paid towards the commission will NOT be refundable.Full agreed price must be paid in full before any files are transferred to the client.
Any payments towards the commissioned items are non-refundable once fully complete and ready to be sent to the client under these terms.

If Breach of contract happens. You will be held to the fullest extent of the law to recover payment and/or all justifiable claims/damage.
